I. AUTO ACCIDENT Situation - Steps to take
1. The first thing you should do following a car accident is to get the other driver’s name, driver license number, date of birth, their insurance policy information (company name, representative contact, name of insured, policy number, claim number). Keep in mind the driver may not be the same person as the insured. Make sure to take photos of any damages for all vehicles involved. If it is a hit and run, call the police immediately, try to secure witnesses, and obtain description for the other vehicle and its driver. If you do not have uninsured motorist coverage, consider obtaining it for your own protection because hit and run situations are common and it may be difficult to locate the other driver and vehicle. Also consider investing in a dash cam for your vehicle.
Seek out care if you're having pain. The insurance company is not responsible to refer you to a doctor.

2. Consider filing a police report. Call 911 if someone is hurt. The Nevada Highway Patrol does a great job gathering information from both parties. Las Vegas Metro Police can be reached for local traffic routes by dialing 311.
3. The third thing that you may want to consider is going to a hospital or urgent care to get checked immediately. You should especially go to the emergency room if you have vomited following a car accident. You may also get checked out by a chiropractor immediately following an accident as long as you're not bleeding and don't have a broken bone.
Chiropractors are healthcare professionals that truly understand soft tissue injuries, joint biomechanics, and effective rehabilitation strategies. The best time to receive care to mitigate a new injury is as soon as possible to reduce swelling, pain, and developing future joint stiffness.
4. When contacted by the other driver’s insurance company, make sure to get the claim adjuster’s full name and all contact information.
5. Question: Who will pay for the medical bills?
II. An explanation on who pays the medical bills:
a.) Third party billing - If you were rear ended, we can bill the insurance company directly so that you don't have to pay for each visit out of pocket. The treatments received have to be within a two year statute of limitations from the start of the claim (usually on day of the accident). If you signed a release with the insurance company, please present a copy showing what time frame the insurance company is agreeing to cover your medical expenses and for how much they are willing to cover. In some cases, you may have to pay for the visit upfront and request reimbursement from the insurance company.
b.) Medpay - This is a no fault additional coverage that can be included in your auto insurance policy by request for taking care of medical expenses that are auto related. Be sure to have a claim number and insurance representative who will be the point of contact, plus fax, email, and mailing address for sending medical records and claim forms for the bill.
c.) Medical lien - When you hire legal representation to help with your process of negotiation with insurance companies and medical providers.
d.) Your own personal private health insurance plan. We are out of network with most insurances, therefore your insurance would be mainly used for referring you to a diagnostic lab for imaging studies, a medical doctor, or another specialist such as physical therapy, pain management, or orthopedist that is able to accept your insurance. Be advised, some health plans do not accept referrals from doctors who are are not contracted as one of their own in network providers, and some doctors or medical facilities may not accept regular health insurance to provide care following an auto collision.
e.) Self-pay, out of pocket using Cash, Debit or Credit Card, Flexible Spending or Health Savings Account. Ask for an itemized bill if you are submitting to the insurance company yourself for claim purposes. This option applies if there are no other coverages available. The doctor may be able to work with you on a reduced rate for immediate payments made upfront for services. Most trauma related treatments require more services and time in the office, therefore are more complex and will be charged accordingly.

III. Following a motor vehicle accident, items to bring in for the first-time office visit:

2. Traffic ticket containing auto insurance information from both parties.

IV. Additional Insurance Coverage, being informed:
Did you know that there is a coverage available through your own auto insurance company known as uninsured/underinsured motorist (UM/UIM)? It protects you and everyone in your vehicle in the event that the person who caused your injury either does not have any insurance or does not have enough in their policy to adequately compensate for your loss. Your UM/UIM can even protect you as a pedestrian who has been hit by someone uninsured or underinsured. Consider adding UM/UIM to your policy and not relying on a liability policy from the other driver alone. As a chiropractor, I've seen too many people get stuck with all the medical bills because the other driver had no insurance. Often, the other driver has no assets either to cover medical expenses. Before seeing a healthcare provider on an uninsured motorist policy, be sure to call your insurance company to open the claim so that you will have a claim number established. If there is a policy available from the other driver, your underinsured motorist coverage will serve as additional coverage once the other driver's policy has been exhausted.
V. Car rental situation
Be sure to check the fine print and make sure the extra insurance you decided to purchase from a car rental place includes uninsured motorist. This will protect you in a hit and run situation. If you are a victim of hit and run, please be sure to contact the insurance company for the car rental place to open a claim and establish a claim number for yourself. Informing the rental place alone will not open a claim automatically for you. You will need to be in touch with the auto insurance company that is insuring the rental place. Also, contact your own auto insurance and open a claim with the department handling your uninsured motorist policy so that both insurance companies will communicate with each other as this will help to cover you.
VI. Minimum policies and signing of a release
Bodily injury is a coverage that is medical related, and is separate from property damage which is the portion for the vehicle. As of January 2025, the minimum coverage amount for bodily injury that drivers are required to carry in their auto policy is 30K/60K in California. And in Nevada, it is currently 25K/50K. For example, if the accident is in Nevada involving someone with a Nevada policy who is at fault, and that driver only has the minimum coverage, their insurance company has a two year statute to cover medical expenses to the injured person for up to 25K. The 50K portion means if there are more than one injured, all injured persons with a claim made who are entitled to compensation can only be covered until that 50K coverage is exhausted.
Some insurance companies may offer an early settlement for your trouble, and to cover a certain amount of medical cost for a certain time period from the date of the accident. If you have received a release form to sign, a check will be often included. If you accepted the check and signed the release, you have to complete all care within the time frame of the dates specified and cannot exceed the amount of medical cost specified.
