I. AUTO ACCIDENT Situation - Steps to take
1. The first thing you should do following a car accident is to get the other driver’s name, driver license number, date of birth, their insurance policy information (company name, representative contact, name of insured, policy number, claim number). Keep in mind the driver may not be the same person as the insured. Make sure to take photos of any damages for all vehicles involved. If it is a hit and run, call the police immediately, try to secure witnesses, and obtain description for the other vehicle and its driver. If you do not have uninsured motorist coverage, make sure to obtain it because hit and run situations are common and it may be difficult to locate the other driver and vehicle. Also consider investing in a dash cam for your vehicle.
Most importantly, seek out care if you're having pain. The insurance company is not responsible to refer you to a doctor. You must try to seek an evaluation for care within the first two weeks of the accident. Not seeking care for 3-4 weeks or more can affect the amount of coverage that is made available for you.

You may also get checked physically by a chiropractor after your accident as long as you're not bleeding and don't have any broken bones. Just because your vehicle does not appear to have sustained heavy damage; it does not mean that everything is "okay" - physically, mentally, and emotionally with either you or the other people in your vehicle. Anytime anyone has been involved in a vehicle collision, the human body has underwent an unusual load of stress, and a physically jarring movement which it is not use to experiencing on a regular daily basis. Keep in mind that once the shock wears off, you might start to notice new areas that may have aches and pain…this is where a chiropractor would come in and help with soft tissue recovery from such bodily injuries. Chiropractors are healthcare professionals that truly understand soft tissue injuries, joint biomechanics, and effective rehabilitation strategies. Please be aware that you should try not to wait more than 30 days without seeking some sort of medical care for yourself. The best time to receive care to mitigate the injury is as soon as possible to reduce swelling, pain, and development of future stiffness.

Medical lien - Should there be any disagreements with an insurance company, or you need to hire legal representation to help with your process, your attorney has a task to ensure that you are getting a fair settlement; a lien does not mean the medical provider is working on contingency, the providers that accept examining and treating patients on a medical lien do not know when, if ever they will be reimbursed for their time. Rest assured, outstanding medial bills may be negotiable under attorney representation should a settlement award not be enough to cover the full medical bill.
d.) Your own personal private health insurance plan. We are out of network with most insurances, therefore your insurance would be mainly used for referring you to a diagnostic lab for imaging studies, a medical doctor, or other specialist that is able to accept your insurance. Be advised, some health plans do not accept referrals from doctors who are are not contracted as in network provider.
e.) Self-pay, out of pocket using Cash, Debit or Credit Card, Flexible Spending or Health Savings Account. Ask for an itemized bill if you are submitting to the insurance company yourself for claim purposes. This option applies if there are no other coverages available. The doctor may be able to work with you on a reduced rate for immediate payments made. Most trauma related treatments require more services and time in the office, therefore are more complex and will be charged accordingly.
III. A further and more detailed explanation below for each lettered choices mentioned above:
a.) Third Party Billing - As of 05-11-23, we stopped accepting unrepresented auto claims where we would directly bill the third party (other driver's insurance). We had the unfortunate experience of 1.) an insurance representative misleading the patient into settling the claim for a lower amount when she was entitled to more where it didn't cover our medical bill, 2.) another patient allowed the statute to collect on a claim in 2 years to run out, 3.) another patient got paid a settlement but didn't bother to tell us or pay our bill, and 4.) we saw the patient but later found out the insurance company was not going to accept liability on the claim. Therefore, all patients treating for an injury claim must sign a medical lien (for patient and attorney) and an assignment of proceeds (for the insurance company) acknowledging the financial responsibility on their part, disclose any attorney representation, or pay $170 a visit to cover the professional cost to this office if they plan to represent themselves. The professional cost is necessary to cover business operation expenses such as rent, staff salary, utilities, office supplies, time for patient care, providing a thorough exam and treatments, medical documentation, and itemized billing statements that would accompany a bodily injury claim.
b.) Medpay (Medical Expense Benefits) is an additional coverage set aside by your own insurance company for medical expenses when you first started your auto policy, as long as you elected to have it; and if you don’t have it, please be advised that it does not cost that much more to have it included in your policy. This ensures that your medical bills are immediately paid regardless of who is at fault following your car accident. In addition, it helps to lower the overall medical cost and will not count against your monthly premium. Medpay will only pay the medical portion of your cost for care until the eligible amount from your policy is exhausted. Make sure to provide your medpay insurance policy number, your insurance company contact information (phone, fax, and address for mailing in all claims). Medpay usually comes in the amount of $1000, $5000, $10000, or $25000 coverage. Your Medpay will cover you for any medical care related to an injury involving an automobile, even getting hit as a pedestrian by another car, or accidentally slamming a car door shut on your own finger.
c.) Attorney presentation - There may be times when you will need legal help to sort things out, and to make the process of recovery for your loss smoother. Upon retaining an attorney, you may sign a medical lien at an approved healthcare provider's office before you begin to receive an exam or treatment. A lien retained with a medical provider is an assignment of a portion of any future settlement benefits you may be entitled as an award from your medical claim. The doctor had provided you with care upfront on the lien, and will be waiting for your case to settle before collecting payment for services. Your attorney will do their best to help you negotiate in getting all of your medical bills paid.
You may also change attorneys at any time if you are not happy with them, but you should inform all medical providers whom you may have a lien with about your new legal representative. As previously mentioned, your attorney will try to help you get all of your bills taken care of, and you should listen to every advice that they may provide to you. We can work with any personal injury attorney of your choice. We can also recommend one that will work with our office if the following occurs... 1.) you are not satisfied with your current one, or 2.) the attorney you are with insists that you only go see their chiropractor, but you would rather treat at our facility.
In the event you have completed or have been released from treatment on a claim that is still open and has not yet settled, but still feel that you need further care, please consult with your attorney. Your attorney has a duty to make sure your medical bills are still reasonably manageable before they can authorize any continuation of treatment with us.
This office is able to work directly with your attorney of choice in providing care to you on a medical lien if your attorney is in Nevada. If your injury took place in Nevada, the State Bar only allows a Nevada licensed attorneys to manage you4 claim. If the cause of your personal injury occurred out of state, and you are residing in Las Vegas wishing to treat with us, we are working with attorneys from California, Arizona, and Missouri who are part of the Ichthus Injury Network. This also means you had sustained an injury in either California, Arizona, or Missouri and are represented by a licensed attorney in the state where the injury occurred.
Please be aware that if you signed a lien and are no longer represented by your attorney, we can forward your lien to your new attorney, otherwise, you may will be responsible for your unpaid medical bills that is enforceable through a collection agency. It may be beneficial to consider actively contributing a small copayment towards the cost of each office visit, which may help to offset some of the cost. But please do not disregard the rest of our bill thinking the copay is the only thing that is owed.
Q: Why is the bill more than $170 per visit when it is on a lien?
A: $170 is the cost upfront to not have to wait to get paid on a claim. When we work with you on a lien, we are agreeing to wait for payment based on the outcome of your settlement. Whenever a lien is involved, there is an itemized billing statement, procedure codes, and a list of diagnosis that is required for claims. Insurance companies cannot negotiate your claim without the aforementioned items. Therefore, personal injury care for recovery from trauma takes an immense amount of time for the doctor and staff, in both, seeing a patient in person in the office, as well as time to prepare all medical records and billing.
d.) Your own private health insurance can help with coverage such as hospital bills or whenever medpay is not available. V. Following a motor vehicle accident, items to bring in for the first-time office visit:

VI. Additional Insurance Coverage Advice:
Did you know that there is a coverage available through your own auto insurance company known as uninsured/underinsured motorist (UM/UIM)? It protects you and everyone in your vehicle in the event that the person who caused your injury in an accident either does not have any insurance or does not have enough in their policy to adequately compensate for your loss. UM/UIM may even protect you as a pedestrian should you get into an accident involving another vehicle. If you live in Las Vegas, you definitely should add UM/UIM to your policy and not rely on a liability policy from the other driver alone. I've seen too many people get stuck with all the medical bills because the other driver had no insurance. Most PI attorneys won't be able to help you if the other driver has no assets to go after which is often the case in a transient place like Las Vegas. Before seeing a healthcare provider on an uninsured motorist policy, be sure to call your insurance company to open the claim so that you will have a claim number established. If there is a policy available from the other driver, your underinsured motorist coverage will serve as additional coverage once the other driver's policy has been exhausted.
VII. Car rental situation
Be sure to check the fine print and make sure the extra insurance you decided to purchase from a car rental place includes uninsured motorist. This will protect you in a hit and run situation. If you are a victim of hit and run, please be sure to contact the insurance company for the car rental to open a claim and establish a claim number for yourself. Informing the rental place will not open a claim automatically for you. Also, be sure to contact your own auto insurance and open a claim with the department handling your uninsured motorist policy so that they will later communicate with the insurance company for the car rental. This will help cover you.

It protects you and everyone in your vehicle in the event that the person who caused your injury in an accident either does not have any insurance or does not have enough in their policy to adequately compensate for your loss. UM/UIM may even protect you as a pedestrian should you get into an accident involving another vehicle. If you live in Las Vegas, you definitely should add UM/UIM to your policy and not rely on a liability policy from the other driver alone. I've seen too many people get stuck with all the medical bills because the other driver had no insurance. Most PI attorneys won't be able to help you if the other driver has no assets to go after which is often the case in a transient place like Las Vegas. Before seeing a healthcare provider on an uninsured motorist policy, be sure to call your insurance company to open the claim so that you will have a claim number established. If there is a policy available from the other driver, your underinsured motorist coverage will serve as additional coverage once the other driver's policy has been exhausted.
VII. Car rental situation
Be sure to check the fine print and make sure the extra insurance you decided to purchase from a car rental place includes uninsured motorist. This will protect you in a hit and run situation. If you are a victim of hit and run, please be sure to contact the insurance company for the car rental to open a claim and establish a claim number for yourself. Informing the rental place will not open a claim automatically for you. Also, be sure to contact your own auto insurance and open a claim with the department handling your uninsured motorist policy so that they will later communicate with the insurance company for the car rental. This will help cover you.
