I. AUTO ACCIDENT Situation - Steps to take
1. The first thing you should do following a car accident is to get the other driver’s name, driver license number, date of birth, their insurance policy information (company name, representative contact, name of insured, policy number, claim number). Keep in mind the driver may not be the same person as the insured. Make sure to take photos of any damages for all vehicles involved. If it is a hit and run, call the police immediately, try to secure witnesses, and obtain description for the other vehicle and its driver.
Most importantly, seek out care if you're having pain. The insurance company is not responsible to refer you to a doctor. You must find and seek care within the first two weeks of the accident. Not seeking care for 3-4 weeks or more can affect the amount of coverage available.
Be sure to refer to your own state DMV website for more tips on how to handle yourself following an auto accident:

2. The second thing you absolutely must do is to try and file a police report. Call 911 if someone is hurt. The Nevada Highway Patrol does a great job gathering information from both parties. Las Vegas Metro Police can be reached for local traffic routes by dialing 311.
3. The third thing that you may want to consider is going to a hospital to get checked immediately should you begin to experience any pain. You should especially go to the emergency room if you have vomited following a car accident. You may also get checked physically by a chiropractor after your accident as long as you're not bleeding and don't have any broken bones. Just because your vehicle does not appear to have sustained heavy damage; it does not mean that everything is "okay" - physically, mentally, and emotionally with either you or the other people in your car. Anytime anyone has been involved in a car collision, the human body has underwent an unusual load of stress, and a physically jarring movement which it is not use to experiencing on a regular daily basis. Keep in mind that once the shock wears off, you might start to notice new areas that have aches and pain…this is where a chiropractor would come in and help with soft tissue recovery from such bodily injuries. Chiropractors are healthcare professionals that truly understand soft tissue injuries, joint biomechanics, and effective rehabilitation strategies. Please be aware that you cannot wait more than 30 days without seeking some sort of medical care for yourself or the insurance company may deny your medical claims.
4. When contacted by the other driver’s insurance company, make sure to get the claim adjuster’s full name and all contact information. And if you do decide to obtain an attorney to represent you, it is advisable to only allow your attorney to handle talking to the insurance company as they are more experienced in this area. Also, anything you say to an insurance company can be later used against you if there is a claim dispute.
5. Before seeing a chiropractor, you should determine a few things, such as who will pay for the medical bills?
II. Brief run down on who pays the medical bills:
a.) Third party billing - We no longer accept third party billing, the patient must either have medpay or obtain attorney representation.
b.) Medpay - additional coverage that can be included in your auto insurance policy for taking care of medical expenses immediately, and it does not matter who is at fault as long as the treatments are related to an incident involving an automobile. Be sure to have a claim number and insurance representative who will be the point of contact before entering the office.
c.) Attorney lien - Should there be any disagreements with an insurance company, or you need to hire legal representation to help with your process, your attorney has a task to ensure you are getting a fair settlement; although medial bills are at a premium, the providers that accept examining and treating patients on a medical lien do not know when, if ever they will be reimbursed for their time. Rest assured, when things are settled, outstanding medial bills may be negotiable under attorney representation.
d.) Your own personal private health insurance plan. We are out of network, therefore this would only be for referring you to a diagnostic lab for imaging studies, a medical doctor, or other specialist. Be advised, some health plans do not accept referrals from doctors who are are not contracted as in network.
e.) Self-pay, out of pocket using Cash, Debit or Credit Card, Flexible Spending or Health Savings Account. Ask for an itemized bill if you are submitting to the insurance company yourself for claim purposes. This option applies if there are no other coverages available. The doctor may be able to work with you on a negotiable rate.
III. A further and more detailed explanation below for each lettered choices mentioned above:
a.) Third Party Billing - As of 05-11-23, we stopped accepting unrepresented auto claims where we would bill the third party (other driver's insurance). We had the unfortunate experiences of 1.) an insurance representative misleading the patient into settling the claim for a lower amount when she was entitled to more where it didn't cover our bill, 2.) another patient allowed the statute to collect on a claim in 2 years to run out, and 3.) another patient got paid a settlement but didn't bother to tell us or pay our bill. Therefore, all patients treating for an injury claim must sign a medical lien (for patient and attorney) and an assignment of proceeds (for the insurance company) acknowledging the financial responsibility on their part, disclose any attorney representation, or pay $170 a visit to cover the professional cost to this office if they plan to represent themselves. The professional cost is necessary to cover business operation expenses such as rent, staff salary, utilities, office supplies, time for patient care, providing a thorough exam and treatments, medical documentation, and itemized billing statements that would support a bodily injury claim.
b.) Medpay (Medical Expense Benefits) is an additional coverage set aside by your own insurance company for medical expenses when you first started your auto policy, as long as you elected to have it; and if you don’t have it, please be advised that it does not cost that much more to have it included in your policy. This ensures that your medical bills are immediately paid regardless of who is at fault following your car accident. In addition, it helps to lower the overall medical cost when the time arrives to settle your claim. Medpay will only pay the medical portion of your cost for care until the eligible amount from your policy is exhausted. Make sure to provide your medpay insurance policy number, your insurance company contact information (phone, fax, and address for mailing in all claims). Medpay usually comes in $1000, $5000, $10000, $25000 coverage. Your Medpay will cover you for any medical care related to an injury with an automobile, even getting hit as a pedestrian by another car, or accidentally slamming a car door shut on your own finger.
c.) Attorney presentation - There may be times when you will need legal help to sort things out, and to make the process of recovery smoother. With an authorization from your attorney, you would sign a medical lien at an approved healthcare provider's office before you begin to receive any exam or treatment. A lien with a medical provider is an assignment of a portion of any future claim settlement you may be entitled to receiving over to the doctor for providing you with care. The doctor, in exchange, had provided you with care upfront on a contingency basis, and will wait for your case to settle. Your attorney will do their best to help you negotiate in getting all of your bills paid. With an attorney, we can work with them to reduce your bill if necessary.
You may also change attorneys at any time if you are not happy with them, but you should inform all medical providers whom you may have a lien with about your new legal representative. As previously mentioned, your attorney will try to help you get all of your bills taken care of, and you should listen to every advice that they may provide to you. We can work with any personal injury attorney of your choice. We can also recommend one that will work with our office if 1.) you are not satisfied with your current one, or 2.) the attorney you are with insists that you only go see their chiropractor, but you would rather treat at our facility.
In the event you have completed or been released from treatment on a claim that is still open and has not yet settled, and still feel that you need further care, please consult with your attorney to ensure that they are alright with you continuing treatment with us, especially if more than 30 days have elapsed since you were last seen by a healthcare provider.
This office is able to work directly with your attorney in providing care to you on a lien if your attorney is in Nevada. Please be aware that this office no longer works with out of state accident cases. If you are receiving care at this office under a lien, you are still responsible for ensuring the medical bill gets paid. The purpose in obtaining an attorney is to help negotiate all of your expenses following an injury. If you signed a lien and are no longer represented by your attorney, we can forward your lien to your new attorney, otherwise, you may still become responsible for a medical bill that is enforceable by a collection agency. Therefore, it may be beneficial to consider actively contributing a small copayment towards the cost of each office visit, which may help to offset how much of your settlement is allocated towards medical bills.
Q: Why is the bill more than $170 per visit when it is on a lien?
A: $170 is the cost upfront to not have to wait to get paid on a claim. When we work with you on a lien, we are agreeing to wait for payment based on the outcome of your settlement. Whenever a lien is involved, there is an itemized billing statement, procedure codes, and a list of diagnosis that is required for claims. Insurance companies cannot negotiate your claim without the aforementioned items. Therefore, personal injury care takes an immense amount of time for the doctor and staff, in both, seeing a patient in person in the office, as well as time to prepare all medical records and billing.
d.) Your own private health insurance can help with coverage such as hospital bills or whenever medpay is not available. However, your health plan is a contract between you as the patient and your insurance company, we are not a party to such a contract. Since we are out of network, we will not be submitting any claims to private health insurance companies or Medicaid relating to an auto accident. You would still be responsible for your own cost at our office. Private health insurance is useful in situations where we have to send you for an x-ray or MRI.
e.) Self-pay - You also have the option to pay out of pocket for all of your treatments, and to later submit documentation on your own for reimbursement from the insurance company. Sometimes if more than a month has passed since you were last seen by a healthcare provider on an open claim, or if you have never seen a healthcare provider in more than 30 days on an open claim, you will likely have to pay out of pocket.

IV. Important things to understand:
1.) Insurance companies are not always obligated to pay and will reserve the right to deny your claim.
2.) When receiving care, it is important to adhere to all of your physician's treatment plan. Your physician will discharge you from care within a reasonable time for your medical condition. When it comes to recovering from bodily injuries sustained in a motor vehicle collision, you not only want a doctor that will aid in getting your life back on track, you will want a doctor who cares about what happens to you after your claim is closed, especially if you may require further care in the future.
3.) It is unethical behavior for anyone to ask their doctor to give them a portion of the medpay when that money is meant for paying medical expenses. It is also unethical to seek a physician under a pretense to obtain a medical bill for the purpose of negotiating a settlement directly with the insurance company, and then not paying the physician for their time and effort in rendering care afterward. Once you enter into any insurance claim, you are still responsible for the medical bills that you generate.

New Patient Intake Forms for Personal Injury (Not for Workers Compensation):
Office Intake forms are now available in either English or Spanish for new patients involved in an auto accident to complete before making an initial appointment or walking in for a consultation and examination. These forms are mainly for patients who were injured in a motor vehicle collision. We do not treat patients under a workers compensation claim. If you need a C-4 form filled out, please try to go to either Concentra or UMC Quick Care.
The following forms in English or Spanish are as follows:
1. Lien = Represented by a personal injury attorney
2. Medpay = Medpay included with your auto policy will be billed.

VI. Additional Insurance Coverage Advice:
Did you know that there is a coverage available through your own auto insurance known as uninsured/underinsured motorist (UM/UIM)? It protects you and everyone in your vehicle in the event that the person who caused your accident either does not have any insurance or does not have enough in their policy to adequately compensate your recovery. UM/UIM may even protect you as a pedestrian should you get into an accident involving another vehicle. If you live in Las Vegas, you definitely should add this to your policy and not rely on liability alone. I've seen too many people get stuck with all the bills cause the other driver had no insurance and all that uninsured driver does is just walk away scot-free. Most attorneys won't be able to help you if the other driver has no assets to go after which is often the case in a transient place like Las Vegas. Before seeing a healthcare provider on an uninsured motorist policy, be sure to call your insurance company to open the claim so that you will have a claim number established.
VII. Car rental situation
Be sure to check the fine print and make sure the extra insurance you decide to purchase from a car rental place includes uninsured motorist. This will protect you in a hit and run situation. If you are a victim of hit and run, please be sure to contact the insurance company for the car rental to open a claim and establish a claim number for yourself. Informing the rental place will not open a claim automatically for you. Also, be sure to contact your own auto insurance and open a claim with the department handling your uninsured motorist policy so that they will later communicate with the insurance company for the car rental. This will help cover you.

IX. List of attorneys for PI or WC injuries in Nevada, including Southern California, Texas, Florida:
The following is a list of legal offices in the Clark county area that in the past have either worked well with Yen Chiropractic in professionally managing motor vehicle collision claims and recovery; or they have come highly recommended among other colleagues in the healthcare profession, and even by my own patients' experience. If you have over $1000 in property damage, it is advisable that you do consult an attorney who specializes in personal injury. We should be able to work with any attorney in town, and you as the patient should be able to chose your own chiropractor. If an attorney or firm is unsure about working with our office, we can recommend someone who will.
Having legal representation allows you to have access to more doctors, specialists, and diagnostic studies; it helps you to negotiate a fairer settlement from the insurance company, and it gives you an opportunity to enter into future litigation if there is a strong enough case, especially when there is not enough insurance policy coverage available to cover all of your anticipated expenses such as attorney fees, medical costs, property damage recovery, and future award resulting from having pain and suffering. It is also crucial to not allow 3-4 weeks or more to elapse without receiving any sort of exam and treatment with a physician or it will become impossible for any personal injury attorney to help you in your loss.
